Sie kennen ja das Ausfuhrverbot der Kunstwerke. —

Es wäre aber der Bewegung sehr schädlich,

wenn die Regierungen dann auf den Gedanken

kämen, dieses sinnreiche Verbot auch auf andere

Gegenstände des greifbaren Vermögens auszu=

dehnen. — Die kleinen Juden würden davon —

et pour cause — am wenigsten betroffen. —

Immer schwerer die Größeren, und Sie endlich, mei=

ne Herren, würde es am spätesten und am

schwersten treffen. — Übersehen Sie nicht, was

das juristische Wesen des Ausfuhrverbots ist: —

Es ist die theilweise Entziehung der Verfügung

über eine Sache, es wird eine Eigenschaft der

Sache — ihre Exportfähigkeit — confiscirt. —

Nun scheint mir aber auch das schon von Übel. —

Und wenn [man] zu confisciren anfängt, wo hört man auf? —

Wir wollen das nicht provociren: aber können

wir's hindern, wenn es im Verlauf unserer Be=

wegung eintritt? — Daß wir darauf nicht aus

sind, Sie zu schädigen — im Gegentheil! — das

sehen Sie schon aus unserem ganzen Antrag. —

The kind of action that the governments would have to take has already been shown in Italy. May I remind you of the prohibition to export works of art.

However, it would be very injurious to the movement if the governments hit upon the idea of extending this ingenious prohibition to other pieces of tangible property as well. The little Jews would be least affected by this—et pour cause [and with reason]; the bigger ones would be hit harder and harder, and you, gentlemen, would be hit the latest and the hardest. Do not overlook the legal nature of this export prohibition. It is the partial deprivation of the right to dispose of an object; one quality of the object, its exportability, is confiscated.

To me even this seems like a bad thing. And once confiscation starts, where is it going to stop?

Let us not provoke this; but can we prevent it if it occurs in the course of our movement? You will see from our entire proposal that we are not bent on harming you—on the contrary!

נזק גדול ייגרם לתנועה אם יעלה בדעת הממשלות להחיל את האיסור החכם הזה גם על חפצים אחרים של הרכוש הנייד. היהודים הקטנים ייפגעו מזה פחות, et pour cause (ומסיבה ברורה). הגדולים יותר ייפגעו קשה יותר, ולבסוף בכם, רבותי, יפגע הדבר באחרונה ובאורח קשה ביותר. אל תיעלם מעיניכם המשמעות המשפטית של איסור הוצאת הדברים מן הארץ: זו שלילה חלקית של הבעלות על חפץ. תכונה של אותו חפץ — הזכות לייצא אותו — מופקעת.

וזה כשלעצמו רע בעיני, וכשמתחילים להפקיע, היכן הסוף?

אין אנו רוצים לגרום שכך יהיה: אבל האם נוכל לעכב דבר כזה אם יוחל בזמן פעילות תנועתנו? שאין בכוונתנו להזיק לכם — כי אם להיפך!
